Petition under Section 482 Cr.P.C. read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner for quashing of FIR No. 0384/2019 registered under Sections 363/376 IPC and Section 6 POCSO Act at P.S. Mundka vis-à-vis the Petitioner-Mohit, son of Girish Pal Singh on the basis of the Settlement. 2.

It is submitted that the Petitioner and the Prosecutrix had got married on 27.06.2020 and she has two children, a boy and a girl from the said wedlock.

The parties are present in person, who endorses the amicable Settlement and accepted the terms thereof voluntarily and have undertaken to remain bound by the terms of the Settlement 4.

matrimonial home with the Petitioner and submits that she has no objection to the quashing of the FIR.

Learned APP for the State submits that there are two Accused, one is Mohit and the other is Kallu and there were two girls who separately went away with these two boys. While the Prosecutrix in this case, went away with Mohit, the other Prosecutrix went away with the other co-accused. 6.

It is fairly admitted that these are in fact two separate cases which are not connected in any way and even though only one Accused has approached. Considering the severity of the allegations contained in the Chargesheet, appropriate orders may be made.

The parties have submitted that all the disputes have been amicably settled and thus, no fruitful purpose will be served in continuing with the FIR. The parties have reaffirmed the terms of the Settlement and submit that the said Settlement has been arrived at between the parties, without any pressure and coercion.

Considering that there are two separate cases, through clubbed in one FIR, the present FIR No. 0384/2019 registered under Sections 363/376 IPC and Section 6 POCSO Act at P.S. Mundka and the Chargesheet vis-à-vis the Petitioner-Mohit is hereby quashed.

The Petition alongwith pending Application, is disposed of accordingly.
