CORAM:

HON'BLE MR. JUSTICE MANOJ JAIN

O R D E R

% 28.08.2025 1.

Petitioner, armed with a decree dated 18.08.2023, filed an Execution Petition which has been registered as Ex No. 182/2023. 2.

The decree holder is stated to be 85 years of age. 3.

The judgment debtor seems to have filed objection in such Execution Petition under Section 47 read with Section 151 CPC. 4.

Fact, however, remains that the limited prayer in the present petition is to the effect that the learned Executing Court be requested to dispose of the Execution Petition in a time-bound manner.

5.

Needless to emphasise that all the civil courts are already fully cognizant of the judgments given by Hon'ble Supreme Court in Periyammal (dead through LRs) & Ors. vs. V. Rajamani & Anr.: 2025 SCC OnLine SC 507 and Rahul S. Shah VS Jinendra Kumar Gandhi & Ors.: 2021 SCC OnLine SC 341 and thus, there is already a specific direction to the learned Executing Courts for expeditious disposal of Execution Petitions, within a period of six months.

6.

The present petition is accordingly disposed of with request to learned Trial Court to dispose of the Execution Petition as expeditiously as possible, while keeping in mind the directions contained in the abovesaid judgments. 7.

Pending application also stands disposed of in aforesaid terms.
