% 19.09.2016 The petitioner and the respondent have amiably resolved the disputes in terms of which an amount of Rs.10 lac is to be paid by the respondent to the petitioner.
Learned counsel for the petitioner submits that in terms of the said settlement and on the assurance that the money as settled would be paid within one week of today by way of a bank draft, he has received instructions to withdraw the petition. Learned counsel for the respondent points out that the Official Liquidator was appointed as the Provisional Liquidator by order dated 14.10.2015. Though no effective proceedings have been taken so far by the Official Liquidator in the capacity of the Provisional Liquidator, given the fact that the matter was resolved amicably by the two parties, the preliminary steps that would have been taken
necessitate that the respondent is directed to pay Rs.25,000/- to the Official Liquidator to deposit the same in the Common Pool Fund. The respondent is, thus, directed to pay the said amount of money by way of a bank draft to the Official Liquidator within a week. Learned counsel for the respondent agrees to this and undertakes accordingly.
The petition and the accompanying applications are dismissed as withdrawn, the appointment of the Provisional Liquidator is vacated.
