Petitioner prays that direction be issued to the Police for fair and impartial investigation. Petitioner also prays that appropriate sections be added and the accused persons be arrested.

It is settled law that no direction can be passed to the Police for arrest of the accused persons.

The prayer for seeking arrest of the accused persons is, therefore, unmerited.

In regard to the prayer seeking fair and impartial investigation, whether the police has not been fair or impartial, can only be ascertained after the final report is filed. No directions are required to be passed at this stage. 5.

In regard to the direction for adding the appropriate sections, concededly, the investigation is still pending. Undisputedly, the police will file a chargesheet alleging offences against the accused persons and appropriate sections will be invoked. Only because as per the petitioner, some sections attracting harsher punishments have not been mentioned in the FIR, cannot be a ground to pass any direction of such nature. 6.

The petition is therefore, dismissed.

Pending application also stands disposed of.
