Though the present petition has been styled as filed under Section 29A(4) & (5) of the Arbitration and Conciliation Act, 1996 ["A&C Act"], however, some prayers other than seeking extension of mandate have also been made in the petition. The present petition is being treated as one filed under Section 29A(4) & (5) of the A&C Act.

Material on record indicates that an Arbitral Tribunal was constituted by this Court on 19.05.2023 to adjudicate upon the disputes between the parties. The statement of defence and counter-claim were filed on 26.09.2023. Taking the said date i.e., 26.09.2023 as the terminus a quo, the period of one year came to an end on 26.09.2024. Since the arbitration proceedings continued, this Court presumed that both sides gave consent for continuation of arbitration and the period of six months from 26.09.2024 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. came to an end on 26.03.2025. This Court is not going into the issue as to whether amendment of pleadings would extend the period under Section 29A(a) of A&C Act or not.

It is stated that examination of Petitioner's witnesses stands concluded and the examination of Respondent's witnesses has to commence. 4.

The Apex Court in Rohan Builders (India) Private Limited v. Berger Paints India Limited, 2024 SCC OnLine SC 2494, has held that an application for extension of the time period for passing an arbitral award under Section 29A(4) read with Section 29A(5) is maintainable even after the expiry of the twelve-month or the extended six-month period, as the case may be.

In view of the facts of the present case, this Court is inclined to regularize the period from 26.03.2025 till today and extend the mandate of the Arbitral Tribunal till 30.09.2026, so that the award can be pronounced. 6.

It is made clear that this Order is only confined to the request for extending the mandate of the Arbitral Tribunal and all the allegations/averments made regarding other aspects which do not pertain to the extension of mandate stand eschewed.

The petition is disposed of, along with the pending applications, if any.
