This is an application for the grant of interim bail for a period of 30 days, filed on behalf of the applicant Umesh Kumar @ Kanhaiya in case FIR no. 261/2024 under Section 420 IPC and 66D IT Act, registered at PS Lahori Gate.

Learned counsel for the applicant submits that the son of the applicant is studying in St. Joan's Public School, Mohali and his school fees for the period of January to October 2025 is due. He further states that the applicant also needs to resolve certain ongoing financial issues concerning his credit card from HDFC Bank which shows an outstanding balance of Rs. 91071/- as per the notice dated 06.03.2025 received by the applicant from the credit card company. He further submits that unless the school fees is paid, the education of the child of the applicant may suffer. 3.

Learned APP submits that applicant was granted interim bail on the same ground in the month of March 2025 and this is the second time that he is asking for the grant of interim bail on the same ground. 5.
In rebuttal, learned counsel for the applicant submits that upon being granted interim bail, applicant had paid the school fees of the child till December 2024 and this time he is seeking interim bail for payment of school fees for the subsequent period and for resolving his credit card payment disputes.

It stands verified that the child of the applicant is studying in the aforesaid school. It is not the case of the prosecution that upon being released on interim bail, applicant in any manner misused the liberty of grant of bail.

Considering the ground made out in the application and in the interest of justice and only on humanitarian ground, the applicant/accused is granted interim bail for a period of 10 days from the date of his release subject to his furnishing a personal bond with a sum of Rs. 20,000/- with a surety of like amount to the satisfaction of the Trial Court/duty Magistrate with condition that he shall not try to contact, influence or threaten or intimidate the witnesses of this case and shall surrender immediately on completion of interim bail period and shall not seek any extension of interim bail on any ground whatsoever.
