By way of this application, learned counsel for respondent No. 2 - Airport Authority of India ["AAI"], seeks expunction of observations made in paragraphs 9 and 10 of order dated 01.09.2025 passed in the captioned writ petition.

The facts and circumstances in which the order dated 01.09.2025 was made have been stated in the said order, and it is unnecessary to repeat them.

I have heard Mr. Sanjay Sharawat, learned Senior Counsel for the applicant. Mr. Ankur Chhibber, learned counsel for the writ petitioner, does not wish to make any submissions on the application, as the matter in issue is essentially between the applicant and the Court. 6.
In the application, the applicant has expressed an unconditional apology for the lapses recorded in order dated 01.09.2025. The applicant has expressed remorse and contrition at the events. Coming from a member of the Bar, the expression appears to be sincere. In these circumstances, the unconditional apology tendered by the applicant, is accepted. Consequently, the observations in paragraph 10 of the said order are recalled, and the costs imposed are waived. 7.
I do not however see any reason to recall paragraph 9 of the order, in which the Court's concern was expressed. Suffice it to state that the concern was, in my view, commensurate with the gravity of the situation. The events narrated in the order imperilled the Court's foremost duty, to do justice in accordance with law.
