% 17.05.2017 This petition is filed under Section 11 of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as the Act) seeking appointment of a sole arbitrator to adjudicate the disputes between the parties.

The petitioners are said to have booked a flat/apartment vide a tripartite agreement dated 22.03.2014 which was executed between the parties and HDFC Bank. A buy back agreement being an MOU for EMI/Pre EMI/Buy Back Agreement was also executed on 04.04.2014. As per Clause 10 of the MOU/Buy Back Agreement dated 04.04.2014, there is an arbitration clause whereby the disputes between the parties will be referred for arbitration to a sole arbitrator to be appointed by both the parties by consent.

Learned counsel appearing for the respondent submits that he has no objection in case this court appoints an arbitrator and requests that the matter be referred to Delhi International Arbitration Centre. Accordingly, Mr.Udit Gupta, Advocate Mobile No.9654449369 is appointed as an Arbitrator. The arbitration shall be done under the aegis of DIAC.
