CORAM:

HON'BLE MR. JUSTICE MANOJ JAIN

O R D E R

% 18.09.2024 1.

Respondent- Mr. Gurdeep Singh Chatha has filed an Execution Petition against Union of India.

2.

It was filed in the year 2019 and it seems that the decree is still not fully satisfied.

3.

When the Execution Petition was taken up by learned Executing Court on 04.09.2023, since the Land and Development Office had made request needing some more time and since the decree holder was insisting for issuance of warrants of attachments, learned Executing Court issued warrant of attachment directing attachment of the bank account only to the extent of decreetal amount in question. 4.

Such order was passed on 04.09.2023 and it is not explained as to why such order is being challenged after more than one year. 5.

The orders which might have been passed in the interregnum have also not been shown. It is not clear whether the attachment order has already been executed or not.

6.

After hearing arguments for some time, learned counsel for petitioner states that he may be permitted to withdraw the present petition with liberty to file petition afresh either before this Court or to file application before the learned Trial Court seeking appropriate relief/recall of attachment order, if it still subsists. 7.

The petition is accordingly dismissed as withdrawn. 8.

Liberty, as prayed, is granted.
