The petitioner retired as an Additional Labour Commissioner in the Government of National Capital Territory of Delhi ["GNCTD"], on 31.01.2025. By way of this writ petition under Article 226 of the Constitution of India, he seeks release of his retiral benefits, including gratuity, pension, leave encashment, and other admissible dues. 2.

At the outset, Mr. Sacchin Puri, learned Senior Counsel for the petitioner, seeks permission to withdraw the writ petition with liberty to approach the Central Administrative Tribunal ["Tribunal"]. withholding his retiral benefits have not been communicated to him. 3.

Ms. Aliza Alam, learned counsel for GNCTD, submits that the respondents will treat the present writ petition as a representation and communicate their response to the petitioner within four weeks. 4.

In the event no response is received within the said period, or if the response is adverse, the petitioner will be at liberty to approach the Tribunal.

The writ petition, alongwith pending application, is dismissed as withdrawn with liberty as aforesaid.
