This is a writ petition for issuance of directions to respondent No. 1 to initiate disciplinary action against respondent No. 3 for not registering the FIR on the basis of a complaint dated 18.08.2025 of the petitioner, in accordance with the guidelines contained in the Constitution Bench judgment of the Hon'ble Supreme Court in Lalita Kumar vs. State. of U.P. & Ors. (2014) 2 SCC 1.

Learned counsel appearing for the petitioner states that Police has registered 3 FIRs against the petitioner at the behest of the landlord, but has refused to register the FIR on his complaint dated 18.08.2025 against the landlord. He further prays that appropriate action be taken against the concerned SHO for not registering the FIR on the complaint of the petitioner.

Learned ASC appearing for the State, submits that a complaint from petitioner was received in the DCP office on 18.08.2025, which has been marked by SHO only yesterday and the complaint is being inquired into. 4.

Learned counsel appearing for the landlord submits that petitioner has alternate efficacious remedy of filing criminal complaint before the Court of learned CJM along with application under Section 175(3) BNSS, 2023. He submits that in the garb of seeking directions by filing a writ petition, petitioner is simply pressurising Police to register the FIR upon his complaint, which is not permissible.

At this stage, after part submissions, Mr. Ashok Kumar, learned counsel appearing for the petitioner, seeks permission to withdraw the present petition with liberty to take appropriate action, as permissible under the law.

The statement made by learned counsel for petitioner is taken on record and petition is dismissed as withdrawn with liberty to take resort to appropriate remedy, as permissible under the law.
