Learned counsel for the plaintiff seeks permission to withdraw the present suit with liberty to re-file the suit on the same cause of action with better pleadings.

This Court has perused the plaint and the documents. The plaintiff has relied upon a family settlement dated 22.02.1996, which is wholly illegible. The plaintiff shall ensure that the legible copy of the document is filed with the fresh plaint.

The plaintiff will also annex the copy of this plaint with the fresh plaint for comparison of the pleadings. A copy of this order shall also be filed.

The plaintiff will also file a detailed disclosure of the alleged rent collected by the plaintiff from defendant no. 4 and defendant no. 5 as averred in the plaint.

With the aforesaid directions, the plaintiff is permitted to withdraw the present suit with liberty reserved in accordance with law.
