MAT.APP.(F.C.) 307/2024 & CM APPL. 54557/2024[Application filed on behalf of the appellant seeking interim relief] 2.

This appeal is directed against the order dated 13.08.2024 passed by the family court. The operative directions issued by the family court reads as follows: "Taking into consideration totality of the facts and circumstances, as agreed, it is directed that respondent shall bring the child Yash Vardhan on 1st & 3rd Saturday of the month from 3:00 pm to 4:00 pm in the Children Room Family Courts East Distt Kkd Courts Delhi to enable the petitioner to meet the child and during the said meetings, the respondent is not allowed to remain there in Children Room."

behalf of the appellant, says that since Saturday is a working day for the appellant, the appellant wants the direction contained in the order dated 13.08.2024 to be modified. In other words, the appellant requires the visitation to be fixed on 1st and 3rd Sunday of every month between 11 AM and 12:00 PM. 4.

Mr Raj Kumar, learned counsel, who appears on behalf of the respondent, says that he would have no objection if such a modification is ordered, provided that the Children's Room at the concerned family court [in short "Children's Room"] is available for interaction.

Ms Singh says that the Children's Room is available for interaction on Sundays at the time indicated above.

The judgment and order dated 13.08.2024 is, accordingly, modified to the extent indicated above.

6.1 It is, however, made clear that in case the Children's Room is not available for interaction on Sunday, the interaction will take place as indicated in the impugned judgment and order passed by the family court. 7.

The appeal is disposed of in the aforesaid terms. 8.

Consequently, the pending application shall stand closed. 9.
