BAIL APPLN. 445/2018 Petitioner is seeking anticipatory bail. FIR No. has been registered under Sections 186/332/353/506 read with Section 34 of the IPC. It is stated that apart from Section 332 of the IPC all other offences are bailable. Incident had occurred on 03.5.2016. As per the allegations, the complainant who was a Head Constable posted at Police Station Kalyan Puri was abused with filthy language. Counsel for petitioner points out that it is the petitioner who had been the victim in the incident because he had received injuries pursuant to which three stitches had been undergone by him. To
substantiate his submission he has placed reliance upon his MLC dated 03.5.2016 (Annexure P4). This Court notes the date of the offence which was 03.5.2016. Proceedings under Sections 82/83 of the Cr.P.C. have been initiated against the petitioner. He is not joining the investigation. Keeping in view the fact that the complainant is a public servant no ground is made out for anticipatory protection.
Dismissed.
