% 22.02.2018 1.

All the 27 petitioners have approached this Court by filing the present petition praying inter alia for issuance of a writ of mandamus for directing the respondent No.3 to change the date and venue of the examination for Senior Secondary Recruits, scheduled on 26.2.2018, at Jamnagar at 6.30AM. 2.

Mr. Chhiber, learned counsel for the petitioners submits that the petitioners are finding themselves in a serious predicament inasmuch as they have applied for two posts advertised by the respondent No.3 i.e., Artificer Apprentice and Senior Secondary Recruits. The examination for the post of Artificer Apprentice is fixed on 25.2.2018 at Jaipur between 2.00PM to 3.00PM and the second examination for the post of Senior Secondary Recruit is fixed for 26.2.2018 at Jamnagar at 6.30AM. Learned counsel submits that the time gap between two examinations is so minimal that it is not practical for the petitioners to sit for the examination at Jaipur that will W.P.(C) 1697/2018

be over only at 3.00PM and take a public transport to reach Jamnagar, which is 990 KMS away, for attempting the second examination scheduled on 26.2.2018, at 6.30AM. Hence, the present petition. 3.

Mr. Jain, learned ASG, who appears for the respondents states on instructions that the respondents are willing to accommodate the petitioners by postponing the examination for the Senior Secondary Recruits scheduled at Jamnagar on 26.2.2018, from 6.30AM to 4.00PM of the same day to give them enough time to travel to Jamnagar. He however clarifies that the aforesaid offer is being made as an exception and may not be treated as a precedent for any other case.

4.

Learned counsel for the petitioners is satisfied with the aforesaid suggestion.

5.

Accordingly, the present petition is disposed of along with the pending applications by directing the respondents to postpone the examination for the post of Senior Secondary Recruits scheduled at Jamnagar on 26.2.2018 from 6.30AM to 4.00PM in respect of all the 27 petitioners herein.

6.

We make it clear that this order shall not be treated as a precedent in any other matter.
