The present application has been filed by the petitioner under Section 151 of the Code of Civil Procedure, 1908 seeking disposal of the present petition in terms of arbitral award dated 10th January, 2026 passed in DIAC Case No. 9420/10/2024 and the Settlement Agreement dated 17th December, 2025.

Learned counsel for the petitioner submits that the parties have entered into a Settlement Agreement dated 17th December, 2025 and, pursuant thereto, a final arbitral award dated 10th January, 2026 has been passed. Learned counsel for the petitioner further submits that in view of the aforesaid facts and circumstances, the present petition has become infructuous and may be disposed of as withdrawn.
