Writ petition under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 ('Cr.P.C.') has been preferred on behalf of petitioner with the following prayer:- "direct the Respondent to provide the adequate protection against Gaurav Dabas"

In brief, as per the case of petitioner, after her brother, Amit Yadav expired on 11.03.2023, one Gaurav Dabas demanded Rs. 50 lacs from her on the pretext that her brother had taken a loan from him and had also issued a cheque of Rs. 50 lacs. Further, he started pressuring the petitioner to repay her brother's loan. When the above liability was denied by petitioner, Gaurav Dabas visited the premises with some goons and further assaulted the petitioner. A PCR call in this regard was further made whereupon Police took the petitioner alongwith her husband to the Police Station and were made to sign some blank papers. complaint is also stated to have been forwarded to DCP concerned, vide letter dated 17.08.2024 for protection and necessary action. 3.

Learned ASC for the State appears on advance notice and, on instructions of IO, submits that proceedings under Sections 126 and 169 of BNSS have been initiated against both the parties. He further submits that no further complaint has been received at the Police Station but a complaint later on forwarded to DCP on 17.08.2024 has been marked to the Police Station, which is being looked into. He further submits that necessary action shall be taken in accordance with law, under intimation to the petitioner and steps, if any required for safety of the petitioner shall be assessed. In view of grievance raised by the petitioner against the Investigating Officer, learned ASC also submits that complaint shall be assigned by SHO to another Investigating Officer.

Taking the statement of learned ASC for the State on record, petition is accordingly disposed of. Pending applications, if any, also stand disposed of.
