W.P. (C) 1662/2017 & CM. No.7445/2017 (stay) Petitioner is aggrieved by an order dated 03.02.2017 passed by the Directorate of Estate/Estate Officer vide which the petitioner has been directed to vacate the staff quarter i.e. Quarter No.1753, Laxmi Bai Nagar, New Delhi. The order dated 03.02.2017 gave him a period of 15 days to vacate the said property from the date of publication of the said order. That period has expired. Petitioner

submits that he has received copy of this order on 08.02.2017. His apprehension is that he will be forcibly evicted from the staff quarter. On advance notice learned counsel for respondent has put in appearance. Submission is that the petitioner has no case; he has admittedly received copy of the order on 08.02.2017 and there appears no reason as to why he has approached to this Court so late. That apart learned counsel for the respondent submits that the statutory remedy available to the petitioner is to file an appeal under Section 9 of the Public Premises (Eviction of Unauthorized Occupants) Act, 1971; this petition is not maintainable. This Court agrees with the submission of the learned counsel for the respondent. Petitioner is advised to approach the appropriate forum by filing an appeal under Section 9 of the said Act. The petitioner is protected for one week; no coercive steps be taken till then.

Petition disposed of.
