This Petition under Section 29A(4) and 29A(5) of the Arbitration and Conciliation Act, 1996, read with Section 7 of the Commercial Courts Act, 2015, has been filed by the Petitioner for extending the mandate of the sole arbitrator in the Arbitration proceedings which are going on between the parties.

Material on record indicates that this Court vide Order dated 22.08.2022, in O.M.P.(T) 5/2022, appointed Ms. Bimla Makin, former District Judge, as the Arbitrator, to adjudicate upon the disputes between the parties.

Vide Order dated 09.12.2023, the mandate of the Learned Arbitrator was mutually extended for a period of six months by the parties as per section 29A(3) of A&C Act.

parties before the Tribunal and the award has been reserved by the Tribunal. It is stated that the mandate of the Tribunal expired on 13.09.2024. The present Petition has, therefore, been filed seeking extension of mandate of the Arbitral Tribunal.

In view of the facts and circumstances of this case, this Court is inclined to extend the mandate of the Arbitral Tribunal for a further period of four months, i.e. till 13.01.2025, so that the award can be pronounced and no further extension of time would be required by the Tribunal. 6.
The Petition is disposed of, along with the pending applications, if any.
