By way of the present petition under Article 226 of the Constitution of India, the petitioner, who is serving in the Indian Air Force and is presently posted at 62 SU, Salua in West Bengal, has approached this Court assailing the order dated 16.07.2024 as also the Signals dated 16.08.2024 and 10.09.2024, vide which she has been transferred to 501 SU Barnala, Punjab. 2.

After some arguments, learned counsel for the petitioner submits that the petitioner would be satisfied in case the respondents were to postpone implementation of the impugned posting order for a period of six months, so as to enable her to get her ongoing treatment (Assisted Reproductive Technology) at Kharagpur completed.

instructions, submits that respondents have no objection to this limited request made by the petitioner.

In the light of this fair stand taken by the respondents, we dispose of the writ petition along with the pending application by directing that operation of the impugned posting order directing the petitioner to report at 501 SU, Barnala, Punjab will not be given effect till 31.03.2025. This would however, be subject to the petitioner filing, within two weeks, an affidavit of undertaking to report at 501 SU, Barnala, Punjab on or before 01.04.2025. 5.

We make it clear that in case, the petitioner does not report at 501 SU, Barnala, Punjab on or before 01.04.2025, it will be open for the respondents not only to initiate disciplinary action against her but also to initiate contempt proceedings against her as per law.
