Mr. Kiran Kumar Patra, counsel for the Petitioner, states that in light of the judgment of this Court in NIUM India Private Limited vs. Union of India & Ors1 he has received instruction to withdraw the present petition and seeks liberty to avail the remedy of filing an appeal under Section 42 of the Prevention of Money Laundering Act, 2002 before the concerned Court. 2.
The present petition is dismissed as withdrawn with liberty as prayed. 3.
In the event an appeal is filed, the same shall be considered on its own merits. The Petitioner's request for condonation of delay in filing the appeal on the ground of pendency of the present writ petition shall be considered by the Appellate Court on its own merits.
