% 04.03.2025 CRL.M.A. 6991/2025 (modification of bail condition in judgment dt. 29-10-2024) 1.

The present application has been filed under Section 528 BNSS seeking waiver of the condition mentioned in para 21 (i) of the judgment dated 29.10.2024 passed by this Court vide which the petitioner was granted bail subject to the condition that 'he shall not leave Delhi/NCR without prior permission of concerned Court and surrender his passport, if any'. 2.

The learned counsel for the petitioner submits that the petitioner has complied with the present condition for the period of four months, however, this condition is posing practical difficulties, in as much as, the petitioner has business out of Delhi/NCR and he needs to travel in respect thereof. 3.

Jain has already been allowed by this Court vide order dated 20.02.2025 passed in BAIL APPLN. 3301/2024.

In view of the above, issue notice. The learned Special Counsel for the ED accepts notice.

Having regard to the submission made by the learned counsel for the petitioner, the condition contained in para 21(i) of judgment dated 29.10.2024 is modified to the extent that 'the petitioner shall not leave the country without prior permission of concerned Court and surrender his passport, if any'.
