Petitioner is defending a commercial suit.

The petitioner did file a written statement but since there was a delay of 76 days beyond the initial 30 days in filing such written statement though, still well within the outer permissible limit of 120 days, the learned Trial Court while permitting written statement to be taken on record, burdened the defendant with cost of Rs.76,000/- calculated @ 1000/- per day.

Mr. Maneesh Kumar, learned counsel for the petitioner, who appears through video conferencing, states that the cost was harsh and excessive, particularly, keeping in mind the fact that the defendant firm was being run by a lady and such firm had already been shut down. It is also claimed that she is not presently working anywhere and there is no source of livelihood.

petitioner states that he may be permitted to withdraw the present petition with liberty to move appropriate application before the learned Trial Court seeking waiver/reduction of the cost. 5.
Petition is, accordingly, disposed of as not pressed. Liberty, as prayed, is granted.

It is expected that if any such application seeking waiver/reduction in cost is filed before the learned Trial Court, the learned Trial Court would consider the same in a sympathetic manner. 7.
