The present Petition under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as "BNSS, 2023") has been filed on behalf of the petitioners seeking to quash the FIR No. 257/2021 registered under Sections 308/506/34 of the Indian Penal Code, 1860 (hereinafter referred to as "IPC, 1860") at Police Station Tigri and all proceeding emanating therefrom in view of the Settlement arrived at between the parties.

Issue notice. Learned APP accepts Notice on behalf of the State.

A request for quashing of the FIR has been made on account of the Settlement inter se the parties. It is stated that the parties run the same business across the street and there was a dispute regarding a mixer machine. and left knee and has been certified as simple. The parties have amicably settled all their disputes. The parties have entered into MOU dated 27.07.2024 and have amicably settled all their disputes. The parties endorse the Settlement and shall remain bound by the terms of Settlement. Pursuant to the Settlement, the mixer machine has been handed over by the petitioners to the complainant/respondent No.2. 4.

The parties are present before this Court in person today, and have been identified by their counsel and Investigating Officer concerned.

Today, the complainant who is present in Court states that he has no objection if the FIR is quashed.

In view of the above facts that the parties have amicably resolved their differences out of their own free will and without any coercion and it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. Moreover, there is no legal impediment in quashing the FIRs in question. 7.

Accordingly FIR No. 257/2021 registered under Sections 308/506/34 of the IPC at Police Station Tigri and all consequential proceedings emanating therefrom are quashed.

The petition stands disposed of.
