% 03.02.2017 Present writ petition has been filed challenging the order dated 21st October, 2009 whereby respondent-DDA has directed the petitioner to pay Rs. 76,92,768/- as additional FAR charges (Provisional) for the year 200809 within ninety days failing which sanction granted will be revoked. It has also been prayed that respondent-DDA be directed to issue a completion certificate which has been denied for the sole reason that additional FAR charges have not been deposited by the petitioner. Petitioner has also prayed for refund of Rs.2 lacs deposited as additional FAR charges with the respondent-DDA.
Today, learned senior standing counsel for DDA, on instruction of
Director (Building), DDA states that additional FAR charges deposited by the petitioner shall be refunded and the order dated 21st October, 2009 shall be withdrawn.
In view of aforesaid statement which is accepted by this Court, respondent-DDA is directed to process the petitioner's completion certificate as expeditiously as possible, preferably within eight weeks in accordance with law.
With the aforesaid observations and direction, present writ petition stands disposed of.
