This petition has been filed for setting aside order dated 01st July, 2024 passed by the MM, Patiala House Courts allowing the respondent to cross-examine the petitioner's witness by allowing the application under Section 311 Cr.P.C.

The petitioner is the complainant in proceedings under Section 138 of the NI Act under CC No.1323/2021.

Counsel for the petitioner, at the outset, states that he is not pressing for the setting aside of the cross-examination request, but considering the medical condition of the complainant, who is suffering from a brain tumour, he prays for expedition in the trial.

matter within six months from the date fixed. However, some reason or the other, the proceedings have got dilated.

The medical documents of the petitioner have been perused; it is noted that petitioner is having meningioma and other collateral issues. 6.

It is, therefore, directed that the Trial Court may expeditiously decide the matter and complete the trial within a period of four months. 7.

Accordingly, the petition is disposed of with the aforesaid directions. 8.
