I.A. 5806/2025 (Application under Order XXIII Rule 3) 1.
The present application has been filed under Order XXIII Rule 3 of the Code of Civil Procedure, 1908 ("CPC"), jointly filed by the plaintiffs and defendant, seeking decree of the captioned suit in terms of the settlement.

The present suit has been filed by the plaintiffs against the defendant seeking permanent injunction restraining infringement of trademark, passing off, damages, rendition of accounts, delivery-up, etc. 3.

Learned counsel appearing for the parties confirm the terms of the settlement and submit that the suit be decreed, in terms thereof. 5.
This Court has perused the terms of the Deed of Understanding dated 27th January, 2025, and finds the same to be lawful. 6.
The parties are held bound by the terms of their settlement. 7.
Accordingly, the present suit is decreed in terms of the compromise/settlement/understanding, as recorded in the Deed of Understanding dated 27th January, 2025 for use of the trademark 'AKG', executed between the parties.

Decree sheet be drawn up.

The present suit, along with the pending applications, accordingly, stands disposed of.
