O R D E R

% 04.09.2019 CM APPL No.39811/2019 In the present matter the following consent order dated 10.12.2018 was passed:

"i) That all claims of the Respondents/Plaintiffs in the suit would stand settled and satisfied on the Respondents/Plaintiffs becoming joint owners of Flat No. M-11, Pratap Bhawan, Bhadur Shah Zafar Marg, New Delhi, the ownership of which shall be transferred by the Appellants to the Respondents.

ii) That whatever amount is lying deposited in this Hon'ble Court by the Appellant, along with interest accrued thereon, be released to the Respondents in full and final satisfaction of all the claims of the Respondents/Plaintiffs in the subject litigation, and which will be in addition to the ownership of Flat."

The ownership of the property viz. Flat No.M-11, Pratap Bhawan, Bahadur Shah Zafar Marg, New Delhi has since been transferred by the appellants in the name of the respondents. However the amount lying deposited with the registry of this Court needs to be

released to Mr.Arvind Lall. The learned counsel for the respondent no.2 pleads for release of the pay order in the name of Mr.Arvind Lall, for his 50% share plus interest accrued thereupon to respondent no.1 who is an attorney of respondent no.2 vide power of attorney dated 10.05.2003.

In the circumstances the Registry to hand over pay order made in the name of Mr. Arvind Lall, for the balance amount of 50% with its accrued interest, to Respondent No. 1.

The application stands disposed of.
