The present application under Order XXII Rule 3 read with Section 151 of the CPC, seeks the following prayers: - "a. Allow the present application and substitute/implead the applicant, Shri Dinesh Kumar ( son of late Shri Yogesh Chandra ), as the legal representative of the deceased petitioner / petitioner for the purpose of prosecuting the present matter; b. Pass any other order(s) as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case." 3.
Without prejudice to the rights and contentions of the applicant, learned counsel appearing on behalf of the applicant seeks leave of this Court to withdraw the present application.

The present petition under Section 25(8) of the Delhi Rent control Act, 1958 seeks the following prayers: - "a) call for the records of EVICTION PETITION BEARING ARC tr-NO. 339/2018, TITLED AS 'SH. YOGESH CHANDRA v/S M/S ROOP CHAND & SONS";
b) set-aside the IMPUGNED JUDGMENT DATED 01.08.2024, PASSED BY THE COURT OF MS. NEETU SHARMA, LD. ARC (CENTRAL DISTT.), TIS HAZARI COURTS, DELHI, IN EVICTION PETITION BEARING NO. E-339/2018, CNR NO. DLCT03- 002609-2018, TITLED AS "YOGESH CHANDRA V/S M/S ROOP CHAND & SONS" and thereby allow the petition and pass a decree in the eviction petition, in the interest of justice; C) pass any other or further order/s as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case, in favour of the Petitioners and against the Respondent." 7.
The present petitioner had passed away on 23.02.2025 during the pendency of the present proceedings. The application, CM APPL. 69398/2025, seeking impleadment of legal heirs of the petitioner was filed on 09.10.2025, and the same has been withdrawn, as noted hereinbefore. 8.
In these circumstances, the present petition stands abated and disposed of, accordingly.
