Heard learned counsel appearing on behalf of the petitioner and the respondent who appears in person.

The prayer made in the instant writ petition essentially relates to the transfer of HMA No.3014/2023 filed by the respondent seeking a divorce. The said divorce petition is stated to be pending before the Family Court, South West District, Dwarka Courts, Delhi.

Learned counsel appearing on behalf of the petitioner submits that at the instance of the petitioner, the proceedings under Section 125 of Cr.P.C. are already pending at Tis Hazari Courts, Delhi. 4.

In addition, the respondent, who appears in person, also states that another proceedings under Section 498A have been instituted by his wife at Tis Hazari Courts, Delhi.

fact that the child is in the custody of the wife and she has to attend the proceedings of a divorce petition at Family Courts, South West District, Dwarka Courts, Delhi, and proceedings at Tis Hazari Court would result in causing prejudice to her.

The interest of justice would be better served if both the matters are directed to be tried before the Court at Central District, Tis Hazari Courts, Delhi.

Accordingly, the proceedings of HMA No.3014/2023 stand transferred to Family Courts, Central District, Tia Hazari Courts, Delhi. 8.

The petition stands disposed of.
