% 11.02.2016 On August 14, 2015, this Court had appointed Mr. R.V. Sinha, Advocate as a Local Commissioner to record the evidence. Learned counsel for the plaintiff states, that the recording of evidence has not yet started. He also prays, that since the suit is valued at less than 1 Crore, the matter be transferred to the concerned District Court.

The plaintiff has filed the suit for recovery. The valuation of the suit is Rs. 47,64,002.46/-.

In view of Notification No. 27187/DHC/Orgl. dated 24th November, 2015 & in exercise of power conferred by Section 4 of the Delhi High Court (Amendment) Act, 2015, (Act 23 of 2015), which came into force with effect from 26th October, 2015 vide Notification No. F.No.L19015/04/2012-Jus dated 26th October, 2015 issued by the Government of India, Ministry of Law, Justice & Company Affairs published in Gazette of India Extraordinary, Part II, Section 3 Sub-Section (ii), the present matter is

liable to be transferred to the learned District & Sessions Judge, Central District, Tis Hazari Court, Delhi. Accordingly, the parties to appear before the learned District & Sessions Judge, Central District, Tis Hazari Court, Delhi on 4th April, 2016.

It is made clear that, henceforth, the concerned Judge of the District Court shall record the evidence.
