% 25.02.2016 Crl.M.A. 3398/2016 (Exemption) Application is allowed subject to just exceptions. Bail Appln. 416/2016 & Crl.M.A. 3397/2016 The present petition has been filed under Section 439 Cr.P.C. for the grant of regular bail. Facts leading to the filing of the present petition are that the petitioner was granted bail by this Court vide order dated 24.11.2015 for the period uptill 20.02.2016. While granting the bail, one of the conditions of bail was that the petitioner

was directed not to leave the country without prior permission of the trial court and shall surrender his passport before the trial court. The period 20.02.2016 has already been expired.

Thereafter one other application Crl.M.A. 3091/2016 was moved on 19.02.2016 in Crl. Rev.P. 731/2015 seeking extension of bail which was disposed of as no bail was granted in the pending revision petition. Today, the petitioner has filed the fresh bail application under Section 439 Cr.P.C. The admitted position is that the petitioner has not surrendered on 20.02.2016 as per the order dated 24.11.2015. At this stage, learned Senior Counsel for the petitioner wishes to withdraw the present petition with the liberty to file the application for the grant of bail after surrender.

Consequently, the present petition as well as application Crl.M.A. 3397/2016 are dismissed as withdrawn. P.S.TEJI, J FEBRUARY 25, 2016 dd
