O R D E R

The present writ petition has been filed seeking a direction to respondents to take action in accordance with law in respect of the unauthorised construction carried out by the private respondent no.3 in property bearing Plot No.16, Gali No.9, Bharat Nagar, New Friends Colony, New Delhi-110025.

Various status reports have been filed on behalf of the respondent no.1/MCD as well as the respondent no.2/SHO.

In terms of the latest status report filed on behalf of the respondent no.1/MCD, the subject property remains sealed. It is also stated that the owner/occupiers of different portions of the said property have filed appeals before the Appellate Tribunal, MCD. However, no interim stay has been granted in their favour.

In the status report filed on behalf of respondent no.2/SHO, it is stated that an FIR has been registered against the private respondent no.3 on a complaint filed by MCD.

Counsel who appears for the owner/occupier of the premises submits that none of the owners are currently occupying the subject property. 6.

Accordingly, the present writ petition is disposed of with the following directions:- i. ATMCD shall decide the application for interim stay filed on behalf of the various owners/occupiers of the said building in an expeditious manner. No unnecessary adjournment shall be given in this regard. ii. Liberty is given to the petitioner herein to file an intervention application before the ATMCD. Needless to state that the same shall be decided in accordance with law.

iii. Further action shall be taken based on the outcome of the appeal. 7.

Till the time the application for interim stay is decided by ATMCD, MCD shall ensure that the entire building remains sealed and the same is not occupied by any person. Further, MCD shall also ensure that no activity is carried out in the said building.

110025 shall ensure that proper investigation is carried out in the aforesaid FIR. The SHO shall also ensure that no further construction is carried out in the subject property.
