The petitioner is invoking the writ jurisdiction of this Court for issuance of an appropriate direction for quashing of the Show Cause Notice dated 04.09.2024.

Learned counsel for respondent No. 1/Govt. of NCT of Delhi, respondent No. 2/DDA, respondent No. 3/the Land & Development Officer, as well as respondent No. 4/MCD are present on advance notice.

Having heard the learned counsel for the parties, although it appears that the property in question has been involved in a long litigation between the petitioner and the respondent Nos. 6 to 8 so much so that the appropriate directions have been passed with regard to the same even by the DRT, New Delhi, as well as this Court and eventually, the petitioner is seeking foreclosure of the present property which was mortgaged in their favour. However, by virtue of the Show Cause Notice dated 04.09.2024, the Land & Development Officer is claiming the property admeasuring 1100 square yards as vacant Government property and laying claim over it. 6.

After some hearing, learned counsel for the petitioner requests that the present writ petition may be treated as a reply to the aforesaid Show Cause Notice and may be decided as per the law. Learned counsel for the respondents has no objection to the same. 7.

The present writ petition is disposed of with direction that the present petition be treated as a reply to the aforesaid Show Cause Notice and after affording an adequate opportunity of hearing to the petitioner including submission of documents, if any, as regards their title to the property, an appropriate reasoned order may be passed in accordance with the law within four weeks from today. 8.

Till then both the parties shall maintain status quo at the site. 9.

A copy of this order be given dasti under the signature of the Court Master.
