O R D E R

The Petitioner filed an application under Delhi Right to Information Act, 20011 on 24th April, 2024 seeking certain information. When the information was not received, an appeal was filed on 27th May, 2024 under Section 7(1) of the Act. The said appeal was disposed of through order dated 30th May, 2024 by directing Respondent No. 4 to provide the information as requested by the Petitioner. Since the information was not provided, the Petitioner invoked Section 9 of the Delhi Right to Information Act, 2001 for imposing penalties on the officer responsible for not providing the information. The said complaint was filed on 14th August, 2024. On the said complaint, the Appellate Authority on 3rd September, 2024 has taken note of the complaint and directed the Deputy Commissioner (Shahdara South Zone)/MCD, to furnish a reply to the original application. The said order reads as follows:

"In continuation of this office letter No.-1196-97 dated 30/5/24, this is to bring to your notice that an Appeal under DRTI Act, 2001, has been filed by Sh. Sachin Meena. The original application under the DRTI Act, 2001, addressed to you was filed by him on dated 24/4/24. The appeal has been filed on the ground that he did not receive any reply within the stipulated time period.

This office has received a complaint received on dated 19/8/24 and after that at PGMS Portal dated 28/8/24 (copy enclosed) in this regard, you are requested to ensure that a reply is furnished to the original application.

The reply has to be furnished under the signatures of the Competent Authority and copy of documents, if any, to be furnished to the appellant, must be certified. Copy of the reply shall be addressed to the appellant with a copy to the Commission. Moreover, to ensure satisfactory reply to the queries posed by the appellant, if required, a hearing may be accorded to him."

As can be seen from the above order, the Petitioner's complaint under Section 9 of the Act is pending and no final decision has been rendered. Therefore, at this stage, the Court finds no reason to entertain the present petition.

The Petitioner's request for imposition of penalty shall be considered by Respondent No.1 on its own merits, in accordance with law. 4.

With the above directions, the present petition is disposed of along with pending application.
