The Petitioner has approached this Court for quashing FIR No.86/2024 dated 30.01.2024 registered at Police Station Rajouri Garden for offences under Sections 288 & 337 IPC on the ground of settlement arrived at between the parties.

Material on record discloses that while working in Kwatra Tent House under the care of the Petitioner, Respondents No.2 & 3 fell down from the height and the present FIR was registered against the Petitioner. It is stated that the matter has been settled between the parties vide Memorandum of Understanding dated 01.04.2024.

The Petitioner and Respondents No.2 & 3 are present in Court today. The parties have been identified by their respective Counsels and the Investigating Officer. Respondent No.2 & 3 states that they have settled all the disputes with the Petitioner out of their own free will, without pressure, coercion or undue influence.

In view of the settlement arrived at between the parties and in view of the fact that the Petitioner has already taken care of the medical expenses of Respondents No.2 and 3, this Court is of the opinion that the instant case is squarely covered by the law laid down by the Supreme Court in Gian Singh vs. State of Punjab, (2012) 10 SCC 303 and no useful purpose will be served in continuing with the present proceedings. Resultantly, FIR No.86/2024 dated 30.01.2024 registered at Police Station Rajouri Garden for offences under Sections 288 & 337 IPC and the proceedings emanating therefrom are hereby quashed. The parties shall remain bound by the settlement and the undertaking given to the Court. 5.
With these observations, the petition is disposed of along with pending application(s), if any.
