This writ petition is filed seeking release of petitioner on furlough for a period of 2 weeks in FIR No.168/2011 under Section 302/34 IPC and Section 27 Arms Act, PS Dwarka Sector 23.

Counsel for petitioner points out that an application seeking furlough has not yet been decided by the Competent Authority. 3.

As per the nominal roll, petitioner has been incarcerated for about 10 years including remission; has no previous involvements and he has been released on furlough and parole on earlier occasions as well. 4.

Counsel for the State submits that the said application shall be decided within a week's time.

Counsel for petitioner states that he is appearing through Legal Aid and submits that furlough is being sought on the basis of cash surety, as was previously allowed as well, since petitioner is unable to furnish surety bond. 7.

This aspect may be brought to the notice of the Competent Authority, which may consider the same, in accordance with law. 8.

Copy of order be sent to Jail Superintendent for information and compliance.
