The petitioner seeks anticipatory bail under Section 438 Cr.P.C. in case FIR No.793/2014 registered under Section 363 IPC at PS Jafrabad. Status report is on record. Sections 366/368/376 IPC and Section 4 POCSO Act have since been added after examination of the prosecutrix under Section 164 Cr.P.C. on 17.12.2014. 2.

The prosecutrix has appeared in person. It is informed that both the petitioner and the prosecutrix have since married and are living together. The prosecutrix has no objection to the grant of bail. Status report also reveals that at present the prosecutrix is residing with the petitioner at A-317, Gali No. 4/5, Chauhan Banger, Delhi in the rented accommodation. The petitioner and the prosecutrix had filed Crl.Writ Petition No.94/2015 apprehending threat to their life at the hands of their parents as they had married against their wishes. This Court had provided police protection to the couple. BAIL APPLN. 239/2015

Considering the facts and circumstances of the case, the petitioner is granted anticipatory bail and in the event of arrest, he be released on furnishing personal bond in the sum of ` 50,000/- with one surety in the like amount to the satisfaction of the SHO/Investigating officer. He shall, however, join the investigation as and when required.

The bail application stands disposed of.
