% 05.04.2018 CM APPL. 12234/2018 (By appellant under Order 23 Rule 3 CPC) This application under Order XXIII Rule 3 CPC read with section 151 CPC seeks disposal of the appeal in terms of the settlement having been arrived at between the parties which entails payment of Rs.3,75,000/- by respondent no. 2 to the appellant towards full and final settlement of the dispute.

The said respondent is in possession of the suit property. The said amount has been paid to the appellant who is present in the Court, through his counsel by way of a Pay Order bearing no. 507411 dated 09.03.2018 drawn on ICICI Bank.

The application is allowed and the appeal is disposed off in

terms of the Settlement.

Since the lis has been settled, the original documents lying in the Trial Court Record pertaining to the suit property be returned to respondent no. 2 after the Registry has retained a certified copy of the same.
