The present petition has been filed seeking following relief: [a] Issue direction to respondent no.2 to decide the representation dated 21.04.2025 submitted by petitioner institution to respondent no.2.

[b] Issue a writ of certiorari for quashing the impugned withdrawal order dt. 22.09.2023 passed by the respondent no. 2 vide which the recognition of the petitioner for B.Ed. course has been withdrawn and;

[c] Issue a writ of certiorari for quashing the order dt. 01.04.2024 passed by the respondent no.1 vide which statutory appeal filed by the petitioner has been rejected.

Mr. Hardik Rupal, learned counsel for the respondent/NCTE at the outset submits that the withdrawal order dated 22.09.2023 which has been impugned herein was also a subject matter of challenge in an earlier writ petition filed by the petitioner i.e. W.P (C) 14153/2024. He submits that the said petition was dismissed vide judgment dated 07.10.2024 by this Court on the ground that this Court does not has the territorial jurisdiction with liberty to the petitioner institution to approach the jurisdictional High Court. 3.

Mr. Rishab Kumar, learned counsel for the petitioner submits that a different view as to territorial jurisdiction has been taken by the Hon‟ble Division Bench in LPA 296/2025 titled as Smt. Gomti Samrak Vigyan Mahavidyalaya vs. National Council for Teacher Education and Anr. However, he fairly concedes that the said LPA had arisen out of another writ petition being W.P (C) 12008/2024 titled as Smt. Gomti Samrak Vigyan Mahavidyalaya vs. National Council for Teacher Education and Anr. 4.

He submits that he wish to withdraw the present petition and will challenge the earlier judgment dated 07.10.2024 in W.P.(C) 14153/2024 by preferring of an appeal before the Hon‟ble Division Bench. 5.

In view of the above, the petition is dismissed as withdrawn. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

The petitioner may prefer an intra-court appeal in accordance with law, if so advised.
