Petitioner seeks a declaration from this Court that the Special Judge under Prevention of Corruption Act can exercise powers under Section 175(3) of BNSS, directing CBI to register FIR. 3.

It appears that the petitioner filed an application under Section 175(3) BNSS before the learned Special Judge (PC Act), but after addressing partly on 07.08.2025, sought permission to withdraw the application with liberty to approach this Court. Accordingly, the application was dismissed as withdrawn with liberty as sought.
