Petition under Article 226 of the Constitution of India read with Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed by the Petitioner seeking quashing of FIR No. 0669/2016 registered under Sections 420 IPC at P.S. Malviya Nagar and all proceedings arising therefrom in terms of the Settlement Deed dated 29.08.2025. 2.
The FIR No. 0669/2016 was got registered under Sections 420 IPC at P.S. Malviya Nagar on the basis of complaint made by the Complainant for cyber crime committed by the Petitioner.

The parties have appeared in person and have been identified by their respective Counsel.

It is submitted that Rs.1,41,000/- of Respondent No. 2 had been taken by the Petitioner by online fraud through Net Banking. Though the money has been received by the Respondent No. 2, as stated in Settlement Deed dated 29.08.2025.

The parties are living abroad. The matter is settled in terms of Settlement Deed dated 29.08.2025 and Complainant have received all the amount, who endorses the Settlement Deed dated 29.08.2025. 6.
It is submitted on behalf of the Complainant that she has no objection if the FIR is quashed against the Petitioners and the other co-accused on account of the Settlement already arrived at between the parties voluntarily, without any fear or coercion.

In view of the submissions made and that there is no other victim of this alleged fraud, the Petition is allowed. Accordingly, FIR No. 0669/2016 registered under Sections 420 IPC at P.S. Malviya Nagar with all the subsequent proceedings is hereby quashed.
