Petitioners herein seek quashing of an FIR No.52/2021 dated 06.02.2021 registered at Police Station Pul Prahladpur, for the offences punishable under Sections 323/354/354B/34 IPC, and all other consequential proceedings arising therefrom, on the basis of a compromise between the parties.

The complainant alleged that petitioner no. 2 came to her house demanding repayment of money (purportedly a loan) and abused the complainant and her family. Subsequently petitioner no. 2 arrived and petitioners No. 1 and 2 assaulted her, insulted her and her husband, which led to the FIR.

It transpires that the parties are known to each other and with the intervention of well wishers, they have settled their dispute amicably vide settlement agreement dated 25.03.2025.

In the aforesaid backdrop, I have heard the counsel and interacted with the complainant who is present in Court. 5.

Learned counsel for the petitioners submit that the parties are neighbours and, with the intervention of near and dears, they have amicably resolved their disputes vide MOU dated 25.03.2025 which is placed on record (Annexure-P-3). He further submits that an affidavit of no objection to the quashing, deposed by respondent no. 2, has also been placed on record.

Both the counsel for Respondent No. 2 and the learned APP for the State concur with the factum of the compromise between the parties and convey their no objection to the quashing of the FIR. 7.

The parties are present in Court, and I have interacted with them. Upon a query put to the complainant qua the settlement, she unequivocally states that the matter has been settled by her of her own volition, without any undue pressure or coercion.

As regards the injuries allegedly suffered, she submits that the allegations were levelled at the relevant time out of sheer anguish and in the backdrop of heated altercation between her and the petitioners, which culminated in the unsavoury incident. She further states that, in view of the settlement, she does not wish to press any charges against the petitioners and would prefer to maintain mutual cordiality rather than hostility, they are well known to each other.

at a mutual compromise, desire to restore cordial relations. 10.

The dispute between the parties, being essentially private in nature and arising out of unnecessary differences between neighbours. In such circumstances, continuation of the criminal proceedings would serve no useful purpose and would rather amount to an abuse of the process of law. Not quashing the criminal proceedings would rather rekindle hostility, whereas quashing the same would promote cordiality and bonhomie between the neighbours.

It is thus deemed just and appropriate to invoke the inherent powers of this Court under Section 528 of the BNSS to prevent undue hardship to the parties and promote mutual goodwill and societal harmony. 12.

Accordingly, the petition is allowed and the FIR No. 52/2021 dated 06.02.2021 registered at Police Station Pul Prahladpur, for the offences punishable under Sections 323/354/354B/34 IPC, along with all consequential proceedings arising there from are hereby quashed. 13.

The petition, along with pending applications, if any, stands disposed of.
