O R D E R

The present proceedings are instituted on behalf of the petitioner seeking quashing of FIR No. 0538/2021 registered under Sections 323 IPC and Section 75 of the Juvenile Justice (Care and Protection of Children) Act, 2000 at Police Station Najafgarh, New Delhi on the ground that the parties have amicably settled their disputes.

Mr. Nawal Kishore Jha, learned APP for the State, on instructions, submits that the petitioner is the only accused and respondent No.2 is the complainant/victim in the present case. It is further submitted that the case is still pending investigation.

Learned counsel for the petitioner states that the petitioner is the father of respondent no.2. He submits that the present FIR was registered due to some misunderstanding and with the intervention of family members and friends, parties have amicably settled their disputes vide settlement deed dated 14.09.2024, a copy whereof has been placed on record. In terms of the said settlement, complainant/victim is now left with no claim or grievance against the petitioner. It is further stated that the parties are now living together since 2022.

The petitioner who is present in Court, have been identified by their counsel as well as the I.O./ ASI Sushma and SI Devender Kumar PS Najafgarh, New Delhi. Respondent no.2 who is present in person along with her mother is also identified by the IO.

The petitioner has shown remorse for his conduct and undertakes not to repeat the same in future. Respondent No. 2 states that she has entered into the aforementioned compromise out of her own free will, volition and without any coercion. He further states that she has no objection if the present FIR and consequent proceedings are quashed. 7.

The parties shall remain bound by the statements made in Court today.

In view of the above facts and considering that no useful purpose will be served in continuance of the proceedings, it is directed that the aforesaid The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

FIR and the consequent proceedings arising therefrom are hereby quashed. 9.
