CORAM:
HON'BLE MR. JUSTICE A.K. PATHAK
O R D E R
% 23.02.2018 It is submitted that petitioners (accused) and respondent no.2 (complainant) have settled their disputes amicably, therefore, FIR No.2872014 under Sections 420/468/471/34 IPC registered at police station Tilak Marg may be quashed. Respondent no.2 is present in Court and has been identified by SI Harkesh Meena of police station Tilak Marg. Respondent no.2 submits that he has settled the matter with the petitioners of his own free will and without any undue force, pressure or coercion. He further submits that he has no objection in case FIR is quashed. Affidavit of respondent no.2 is also on record in support of the petition.
Keeping in mind that a settlement has been arrived at between the petitioners and respondent no.2 voluntarily, in my view no fruitful purpose would be served to keep the criminal proceedings pending.
Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom, are quashed. Petition is disposed of in the above terms.
Miscellaneous application is disposed of as infructuous. Dasti. A.K. PATHAK, J FEBRUARY 23, 2018 sm
