After some arguments, the learned counsel appearing for the appellant seeks to withdraw the present appeal with liberty to move before the learned single Judge for vacation of the ex-parte ad-interim order passed under Order XXXIX Rule 1 and 2 of the Code of Civil Procedure, 1908. 2.

Accordingly, the present appeal is dismissed as withdrawn with the aforesaid liberty. The pending applications are also disposed of. 3.

If such an application is moved, we request the learned single Judge to consider the same as expeditiously as feasible.
