The learned counsel for the appellant has stated that the proposal which has been given by the court for settling the matter with the respondent has been accepted in principal by the appellant and in token of the said acceptance, a cheque for a sum of Rs.4,06,997/- drawn on Central Bank of India dated 13.5.2016 has been handed over to the learned counsel for the respondent.

On instructions from his client, who is present in court, the learned counsel for the respondent has accepted the said proposal and has stated that subject to encashment of the aforesaid cheque, the matter shall stand settled and no amount whatsoever shall be due and payable by the appellant to the respondent.

The learned counsel for the appellant has assured the court that the cheque will be duly honoured on presentation. 4.
In view of the aforesaid statement made by the learned counsel for the parties, the matter is treated as disposed of in terms of the
above. In the event of the cheque being dishonoured, the respondent shall be at liberty to move an application to restore the matter. V.K. SHALI, J.
