"Allow the present petition seeking appropriate directions/ order to the executing court of Sh. Naveen Gupta ADJ-09, Dist. West, Tis Hazari Courts, Delhi, appropriate order, whereby directing the ld. Executing Court to release the excess amount deposited by the Petitioner vide order dt. 08.05.2024, to the tune of Rs. 11,40,661/- in execution Petition no. 61175 of 2016, titled Pawan Kumar Dhawan Vs Manjeet Singh through LR's, as the same application for release of the excess amount is still pending adjudication and not been decided till today; AND/OR

2. Any other Order(S) as this Hon'ble Court may deem fit." 2.

There is no specific order challenged in the present proceedings. application before the execution court, as submitted by learned counsel for petitioner.

That being so, the present petition is not just devoid of merit but completely frivolous and waste of judicial time. 4.

Learned counsel for respondent no. 1/DH refers to Annexure P-11, which also is a petition filed by the petitioner/JD and the same was withdrawn with liberty to file fresh petition after disposal of the pending application.

The petition is dismissed with cost of Rs.10,000/- to be deposited by the petitioner with DHCLSC within one week.

In order to ensure compliance qua cost, copy of this order be sent to the learned execution court.
