% 23.02.2018 Vide the present petition, the petitioner has prayed for issuance of writ of certiorari and quashing of order dated 27.08.2013 passed by respondent no.2, whereby the petitioner's application dated 25.12.2012 for grant of recognition for B.Ed course in the petitioner/institute was rejected on the ground that there was ban by the State of Haryana from opening of new Institutes.

Learned counsel for the petitioner submits that in November, 2017 the respondents have now taken a considered decision to process similar applications made by Institutes before the imposition of the State ban and, therefore, he may be granted liberty to approach the respondents with a request to consider his application by ignoring the State ban. The learned counsel for the respondents does not have any objection to the said course of action. Accordingly, the petitioner is granted liberty to approach the respondents with a request for

considering the petitioner's application dated 25.12.2012 afresh by keeping in view their own subsequent decision as also the petitioner's claim that they have already invested huge money in setting up a large institute as per the NCTE norms.

The petitioner is granted liberty to move an appropriate application before the respondents within two weeks. It is directed that in case such application is made by the petitioner, the same would be considered by the respondents as per rules and on its own merit by passing a reasoned and speaking order within four weeks.
