The petitioner seeks anticipatory bail in FIR No. 46 of 2018 under Sections 376/506 of the IPC registered at Police Station Vasant Kunj, (North District), South-West Delhi.

The petitioner has already been arrested. In view of the above, the present application has become infructuous. 3.

The prayer of the petitioner that petitioner be granted regular bail, cannot be entertained in view of the fact that the subject application is under Section 438 Cr. P.C. which comes into play in a case where a person has reasons to believe that he is likely to be arrested of having committed an offence under non-bailable warrants. In the subject FIR, petitioner has already been arrested on accusation BAIL APPLN. 451/2018

of having committed an offence under NBWs.

It is submitted that the petitioner has already filed application for grant of regular bail before eh Sessions Court. 5.
